Acceptance of Terms
By accessing this website or engaging Workbence Agency for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
Services
Workbence Agency provides custom software, design, and consulting services, including but not limited to software development, web and mobile development, UI/UX design, cloud and DevOps, AI/ML engineering, data engineering, QA and test automation, cybersecurity and penetration testing, and technology consulting. The specific scope, deliverables, timeline, and fees for any engagement are defined in a separate written agreement or statement of work between Workbence Agency and the client.
Client Responsibilities
Clients are responsible for providing timely feedback, access, and materials reasonably required for us to perform the agreed services, and for the accuracy of information they provide to us.
Intellectual Property
Unless otherwise agreed in writing, ownership of custom deliverables created specifically for a client transfers to that client upon full payment. Workbence Agency retains ownership of its pre-existing tools, frameworks, and know-how, and may reuse general methods and non-confidential learnings in future engagements.
Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with an engagement, and to use it only for the purposes of that engagement.
Payment Terms
Fees, payment schedules, and invoicing terms are specified in the applicable project agreement or statement of work. Late payments may result in a pause of services until accounts are brought current.
Warranties & Limitation of Liability
Services are provided on a professional, good-faith basis. Except as expressly agreed in a signed contract, Workbence Agency makes no other warranties, express or implied, and our aggregate liability for any claim is limited to the fees paid for the services giving rise to the claim.
Termination
Either party may terminate an active engagement in accordance with the terms of the applicable project agreement. Fees for work completed prior to termination remain payable.
Changes to These Terms
We may revise these Terms of Service from time to time. The "Last updated" date below reflects the most recent revision. Continued use of our website after changes take effect constitutes acceptance of the updated terms.
